EU AI Act in Force: Effective Dates and Phased Obligations

The EU AI Act entered into force on August 1, 2024, but its rules applied in stages. See the 20-day legal mechanism and deadlines later moved by the Digital Omnibus.

A twenty-day rule, not a negotiated date

Regulation (EU) 2024/1689 was published in the Official Journal of the European Union on July 12, 2024, carrying the citation OJ L, 2024/1689. Article 113 sets entry into force at the twentieth day following that publication, which lands on August 1, 2024. [2][3]

Atlas interpretation: Nobody picked August 1 for symbolic reasons. It is arithmetic: twenty days after whatever day the final text happened to reach the Official Journal. The twenty-day rule is the European Parliament and Council's standard mechanism for regulations generally, applied here without modification. [3]

In force is not the same as applicable

The European Commission's own announcement of the entry into force describes the Act as establishing a legally binding framework, but the substantive obligations it created did not start on August 1, 2024 itself. Article 113 lists a separate schedule of application dates for different parts of the regulation, each expressed as a fixed number of months after this entry-into-force date rather than as a standalone commitment. The prohibitions on practices such as social scoring and untargeted facial-recognition scraping, plus the Act's general provisions and definitions, became applicable six months later, on February 2, 2025. Governance rules and the general-purpose AI model obligations followed twelve months out, on August 2, 2025. The bulk of the high-risk-system rules were originally set for twenty-four months out, August 2, 2026, with the Annex I high-risk category given until August 2, 2027. [3][4]

Why the date mattered later, when the schedule moved

Atlas interpretation: Because every later deadline in Article 113 is defined as an offset from entry into force rather than as an independent calendar date, August 1, 2024 is the fixed point the rest of the Act's schedule hangs off. That structure is also what made a later deregulatory push land as a set of postponements rather than a rewrite: the 2026 Digital Omnibus on AI, applying from July 27, 2026, pushed the Annex III high-risk deadline from August 2, 2026 to December 2, 2027, and the Annex I deadline from August 2, 2027 to August 2, 2028, without touching the entry-into-force date or the earlier prohibitions and general-purpose AI deadlines those offsets were originally counted from. Atlas interpretation: That is the practical significance of this date. Industry lobbying for more time repeatedly targeted the high-risk-system schedule, and it succeeded there, but the clock the Commission and Parliament actually moved was still being read from August 1, 2024. Nothing about that date itself changed; only how far downstream from it certain obligations were allowed to land. [4]
