A signed replacement, with staged application
Polis signed SB26-189 on May 14, 2026. The act repeals and reenacts the earlier statutory provisions, defining covered automated decision-making technology used to materially influence consequential decisions. It sets developer documentation and consumer notice, correction and human-review requirements, with enforcement assigned to the attorney general. [1][2]
Section 5 generally makes the act effective January 1, 2027 and applies it to consequential decisions made on or after that date. Specified rulemaking and appropriation provisions take effect upon passage. The bill record’s May 14 effective-date header therefore does not mean all consumer-facing duties began immediately. Contemporary coverage confirms the May 14 signing in Denver. [1][3]
